Mediation in Family Law
Family disputes, especially those involving parenting or property matters, can often be resolved through Family Dispute Resolution (FDR), which is a form of mediation.
Why Mediation?
Mediation is a less formal and often less costly way to resolve family law issues. It allows both parties to express their concerns and reach a mutually agreeable solution with the help of a neutral third-party mediator.
Mediation Process
- Both parties attend the session with their mediator.
- Discussions are confidential, and no decisions are made without both parties’ consent.
- If mediation results in an agreement, it can be formalized through Consent Orders.
- If mediation fails, a Section 60I Certificate may be issued, allowing the matter to proceed to court.
Benefits of Mediation
- Cost-effective: Mediation is usually less expensive than court proceedings.
- Less Stressful: Mediation is generally quicker and less adversarial than going to court.
- Confidential: The process is private, and nothing discussed can be used in court.
